CONDITIONS OF SALE

 https://www.dominikahome.com is an e-commerce website (hereinafter, “the Online Store”) 
The General Terms and Conditions regulate the distance selling relationship between DominikaHome.com and the user or client, in accordance with the legal stipulations, in particular, Law 7/1998, of April 13, on General Terms and Conditions of Contract, Law 26/1984, of July 19, General for the Defense of Consumers and Users, Royal Decree 1906/1999, of December 17, 1999, which regulates Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.
The Client is the natural or legal person who contracts the products or services marketed from the Online Store.

    https://www.dominikahome.com reserves the right to modify the contents, products or services marketed from the website, as well as the commercial offers and prices presented at any time.

https://www.dominikahome.com makes every effort within its means to offer the information contained on the website truthfully and without typographical errors. In the event that at any time an error of this type occurs, which is at all times beyond the control of https://www.dominikahome.com, it will be corrected immediately. If there is a typographical error in any of the prices shown and a Customer has made a purchase decision based on said error, https://www.dominikahome.com will inform the Customer of said error and the customer will have the right to cancel their purchase without any cost on their part.

Such responsibility falls at all times on the manufacturers, producers or distributors of said products. The Client understands that https://www.dominikahome.com is a mere intermediary between him and said manufacturer or distributor.

  1. Purchasing Procedure
    To make a purchase, the Customer must select the products he/she wishes to purchase and add them to the shopping cart by clicking on the “Add to cart” button. Once he/she has added the products he/she wishes to purchase to the cart, he/she must click on the “Complete purchase” button.

To process the order, you must provide the requested information, unless you are registered as a customer, and choose the payment method you prefer. Once the requested information has been provided and the order has been accepted by the Customer, the purchase has been made.

The order will be processed once https://www.dominikahome.com has received the payment correctly, using any of the payment methods available at https://www.dominikahome.com.

Bank transfers: Any order that remains pending for payment by bank transfer will have a maximum period of 5 calendar days to be paid by the customer. If within a period of 5 days the customer has not made said payment by bank transfer, the order will be automatically cancelled and the prices, offers or promotions that may have existed in the order previously will no longer be valid if they have been modified by https://www.dominikahome.com.

The price stated on https://www.dominikahome.com includes shipping costs with delivery to the street (depending on the province), but does not include assembly or delivery costs to the home. . There are products that can only be sent to specific provinces (the permitted provinces will be indicated on the product sheet). Shipping or assembly costs (if applicable) will depend on the province selected for delivery.

The delivery time will be the one indicated at any given time for product availability.

  1. Payment method
    When placing the order, the customer can freely choose to pay for their purchases using a credit card (Visa and MasterCard) and/or bank transfer or financing. The order will be processed once https://www.dominikahome.com has received full payment for the item correctly, using any of the payment methods mentioned above. In certain cases and to prevent possible fraud, https://www.dominikahome.com reserves the right to request a specific payment method in the event that the buyer’s identity is not reliably proven.

    • The Online Store offers a single shipping system that is carried out by transport operators and not by the Online Store.

The price expressed on https://www.dominikahome.com includes shipping costs with delivery to the street level for the entire peninsula (depending on the province, we do not ship to the Balearic and Canary Islands), but does not include assembly or delivery costs to the home.

Therefore, all deliveries will be made at street level. Customers interested in hiring assembly or delivery to their home will have to check with Dominika Home if this service is possible, paying all the costs estimated by https://www.dominikahome.com, which may vary depending on the type of delivery, product and geographic delivery point.

The transport, delivery and/or assembly service of the purchased products is always carried out by companies external and independent of us, so said companies will be the only ones responsible for any damage or harm caused to the client by the provision of the aforementioned services.

We only ship to the peninsula . For shipments to the Balearic Islands and rest of the World , the customer can contact us on admin@dominikahome.com

https://www.dominikahome.com sends orders to its customers through different transport companies of recognized national and international prestige. The delivery date at the Customer’s address will be a maximum of 75 business days from receipt of payment for the purchase of the product and will depend on the availability of the chosen product and the shipping area. Transport times are indicative. The online store will not be responsible if the delivery of products is not carried out on time due to cases of force majeure or fortuitous event. And this may include, but is not limited to:
o Strikes, lockouts or other protest measures.
o Civil unrest, revolt, invasion, threat or terrorist attack, war (declared or not) or threat or preparation for war.
o Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
o Impossibility of using trains, ships, airplanes, motor transport or other means of transport, public or private.
o Inability to use public or private telecommunications systems.
o Acts, decrees, legislation, regulations or restrictions of any government or public authority.

Delivery will be made by making the product available by https://www.dominikahome.com or by a third party on behalf of https://www.dominikahome.com at the address within the geographical area indicated by the customer in the purchase order. The customer assumes the risks of deterioration, damage, damage and loss of the products from the moment the products have been made available to him in accordance with this clause. In the event that the products are damaged due to transport, the customer must indicate the anomalies on the carrier’s delivery note. In this case, https://www.dominikahome.com will repair or replace the defective products as soon as possible. Regarding sleeping items such as mattresses, the customer must not unpack them before ensuring that the product received corresponds to their order, since for reasons of hygiene, these items cannot be exchanged or returned once their plastic cover has been removed, without prejudice to the return of those products that have manufacturing defects. The customer must never throw away the packaging of the products until they have checked that they are in perfect condition and verified that all the products match those ordered.

The customer will ensure and be responsible for ensuring that the products purchased fit through the common accesses of the property in which they will be delivered. If the use of mechanical means for delivery is necessary, the customer must notify https://www.dominikahome.com in advance, and the cost and risk thereof will be borne by the customer. Once the notification has been received, https://www.dominikahome.com will communicate the cost of using these means prior to delivery, as well as the new delivery time that will be required due to the availability of these means not initially foreseen.

https://www.dominikahome.com shall be released from compliance with its delivery obligations set forth in the clause of these General Conditions of Purchase and declines all responsibility in this regard in the following cases: Total or partial non-payment by the customer of the purchase order / omission or inaccuracy of the information that the customer must provide in the purchase order at the time of placing the order / impossibility of delivery of the order at the indicated place due to lack of adequate access or any other cause attributable to the customer.   1. Product conditions
    The customer accepts that the colours and shades of the products in the online store displayed on the monitor or other device may present slight variations in tone and colour different from the product, compared to those received in the order, especially if it is solid furniture or veneered with natural raw materials, leather, stones, fabrics, if they come from different suppliers or if the orders are not made at the same time. The customer declares to be aware of the measurements, shapes and arrangement of the products that make up their order in accordance with the specifications expressed in the online store.

8.Customer Rights and Return Policy:
https://www.dominikahome.com does not guarantee its Customers the availability or delivery time of the products offered on the website, except for those products for which a specific guarantee or availability is expressly stated.

https://www.dominikahome.com guarantees its customers the possibility of cancelling their order at any time and without any cost, provided that the cancellation is communicated before the order has been prepared and made available to the carrier for shipment.

The customer will have a period of 14 calendar days from the date of delivery of the order to cancel the contract and return the purchased product, provided that it has not been opened or used and retains its original packaging. Returns of orders manufactured at the customer’s request or assembled in the factory at the customer’s request will not be accepted. The date of the delivery receipt will be used to calculate the 14 calendar day period referred to in this clause. The customer will notify https://www.dominikahome.com within the stipulated period and by any means permitted by law, of their desire to exercise the right to cancel the contract. The returned order must be delivered together with the delivery note and invoice issued to https://www.dominikahome.com.

Given the nature of the product, claims will be accepted for products that are damaged due to transport. To do so, the Customer must state this in the carrier’s receipt book.

The customer may return any item purchased in the online store (except for products manufactured at the customer’s request and assembled in the factory at the customer’s request, which are not eligible for returns) from https://www.dominikahome.com as long as the products have not been opened or used and retain their original seal or packaging within 14 days of delivery of the order. https://www.dominikahome.com will refund the customer the amount paid within a maximum period of 30 business days after receipt of the product by https://www.dominikahome.com, deducting the amount of shipping and transport costs that will be borne by the customer with a minimum of €35, as long as the product was received by https://www.dominikahome.com under the conditions established in the previous section.

For made-to-order products (manufactured or assembled in the factory at the customer’s request), returns are not accepted.

We remind you that when exercising your right to return, once the product has been delivered, we will refund the money paid for the product(s) purchased, deducting the transport costs derived from the delivery of the product (minimum €35).

After receiving the product or products in our warehouse and checking their condition, the customer will receive the amount of their refund, minus shipping costs, in the same payment method used or by bank transfer within a maximum period of 14 business days.

In the event that the returned products have any defects, the customer must compensate https://www.dominikahome.com for the amount corresponding to such defects, deducting https://www.dominikahome.com said amount from the amount to be reimbursed to the customer as a result of the return. The refund of the purchase money will take place through the payment method used by the customer. In cases where the payment was made by bank transfer, the refund will be made to the account indicated by the customer.

By way of exception, the right of withdrawal will not apply in the following cases: When it concerns products intended for personal use, such as mattresses, which have been unpacked or the protective cover has been removed; and in general, when it concerns products made according to the client’s specifications or clearly personalized that, due to their nature, cannot be returned or may be damaged. In particular, without this list being exhaustive, the following are considered products for which withdrawal from the purchase is not possible: rest products, mattresses will also not be exchanged or returned. Likewise, sofas, armchairs and other complementary furniture that have been made expressly at the client’s request (choice of upholstery, size or adaptation).

If a product other than the one requested by the Customer is delivered by mistake by https://www.dominikahome.com, it will be withdrawn and the correct product will be delivered without any additional charge to the Customer. For any incident related to the return of items from our store, you can contact the Customer Service department via email: admin@dominikahome.com.

8.1 Return for breakages:

Any breakage or defect must be reported within 24 hours of receiving the merchandise, otherwise https://www.dominikahome.com will not be responsible for replacing any broken or defective part.

The merchandise must be perfectly packaged as received by the customer so that the transport agency can collect it. If the merchandise is not well packaged https://www.dominikahome.com will not be responsible for collecting or replacing any broken or damaged part for exchange. The customer must deliver the damaged part or product perfectly packaged, as received, to the transport agency that https://www.dominikahome.com will send to collect said merchandise. It must be packed in its original packaging to be collected by the transport agency.

The new replacement part or product for the damaged or defective product will not be sent to the customer until https://www.dominikahome.com has collected (via transport agency) and received the damaged part at its facilities. Once the damaged product or part has been received at Dominika Home, the new product or part will be sent to the customer.

9.Customer Obligations
The Customer of https://www.dominikahome.com undertakes at all times to provide truthful information about the data requested in the user registration or order forms, and to keep them updated at all times.

The Client accepts the general conditions contained in this contract.

https://www.dominikahome.com will provide the Client with an identifier and a password (as appropriate, chosen by the Client). The Client undertakes to keep his/her personal access keys confidential and with the utmost diligence.

10.Security and confidentiality:
https://www.dominikahome.com guarantees security and confidentiality in all its transactions. All operations are carried out through a secure server, based on the SSL standard that protects data.

All personal data provided by the Client to https://www.dominikahome.com will be included in a personal data file created and maintained under the responsibility of Dominika Niedbala In compliance with the provisions of Organic Law 15/1999 of December 13, on the Protection of Personal Data, the Client may at any time exercise the rights of access, rectification, cancellation and opposition over their personal data by communicating it by email to admin@dominikahome.com .

11.Availability
https://www.dominikahome.com does not guarantee the continuous and permanent availability of the online store service. It is therefore exonerated from any liability for possible damages caused as a result of the lack of availability of the online store. In these cases, https://www.dominikahome.com will make its best efforts to notify 24 hours in advance of the interruption. https://www.dominikahome.com will not be responsible for the interruption, suspension or termination of the online store service.

  1. Applicable legislation and competent jurisdiction

Purchases made with https://www.dominikahome.com are subject to Spanish law. In the event of any conflict or discrepancy, the competent jurisdiction will be that established by Spanish law in its consumer and user law. For the resolution of any controversy, the parties will submit to the Courts and Tribunals of the registered office of the person responsible for the website.

13.Nullity and ineffectiveness of clauses
If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will only affect said provision or the part thereof that is null or ineffective, with the rest of these general conditions remaining in force, such provision being considered totally or partially as not included.
